How to legally transport cannabis in Oklahoma
You’ve got your grow license and harvest is on the horizon. How you will get your product from place to place can be a confusing next step to navigate.
OMMA issues a transporter certificate to every license type able to transport upon approval of their application—that’s dispensaries, grows, processors and transporters. You might assume that’d be sufficient to get your product from point a to point b, but without a transporter agent license you still are not legally allowed to transport cannabis, even as a licensed transporter. The transporter license issued with your OMMA certificate is for your business—it licenses your business to transport medical marijuana. Every person who transports medical marijuana on behalf of your business will be required to have a transporter agent license. That’s the sometimes overlooked nuance that has the potential to catch you in a bind delivering without proper licensing. When you deliver your product, for example from a grow to a dispensary, your transporter agent license will be required upon receipt or it cannot legally be accepted. Further, if you are pulled over transporting cannabis and unable to provide a transporter agent license to an officer you will be subject to penalty of the law for possession with intent to transport.
Transporter licenses are applied for within existing commercial business complia accounts. We recommend applying for your TA license as soon as you’ve received OMMA approval for your business license. This way you can ensure there will be no lag time between when you’re ready to move product and when you’re legally licensed to. As a business owner you and/or your transporter agent will need to submit verification of employment with the licensed business and the same proof of Oklahoma residency required for all other license types—2 years consecutive prior to the application or 5 years consecutive in the previous 25.
Transporter agents are only allowed to transport product for the business that they are employed by as a transporter agent. To transport on behalf of other businesses, you would need a stand-alone commercial transporter license which has its own separate business application and set of requirements.
